Terms of Service

Effective Date: July 6, 2026

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the services, facilities, website, booking systems, communications, and related offerings provided by Lumière Atelier Beauty Studio (“we,” “us,” “our,” or the “Studio”).

By booking an appointment, purchasing a service, visiting our premises, using our website, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all clients, customers, visitors, and users of our services in Canada, subject to applicable federal, provincial, and municipal laws, including consumer protection, privacy, health, safety, and anti-discrimination laws.

2. Scope of Services

Lumière Atelier Beauty Studio provides beauty and personal care services, which may include, without limitation:

Service descriptions, availability, duration, pricing, and recommended aftercare may be provided on our website, booking platform, in-studio, or by direct communication. We reserve the right to modify, discontinue, or limit any service at any time, subject to applicable law and any confirmed booking already accepted by us.

All services are provided for cosmetic and aesthetic purposes only and are not intended to diagnose, treat, cure, or prevent any medical condition.

3. User Obligations and Responsibilities

By booking or receiving services from Lumière Atelier Beauty Studio, you agree to:

You acknowledge that failure to disclose relevant information may increase the risk of adverse reactions, reduced service results, or injury, and may limit or eliminate our responsibility to the extent permitted by law.

We reserve the right to refuse, suspend, or discontinue services if, in our reasonable judgment, it is unsafe, inappropriate, or impractical to proceed.

4. Payment Terms and Conditions

All prices are stated in Canadian dollars unless otherwise indicated. Prices, taxes, fees, and service inclusions may change without prior notice, except for appointments already confirmed at a quoted price, subject to applicable law.

Payment is due at the time of service unless otherwise stated in a written booking confirmation or invoice. We may require deposits, pre-authorizations, or full prepayment to secure certain appointments or packages.

Accepted payment methods may include cash, debit, credit card, e-transfer, or other methods we make available from time to time. You are responsible for any bank charges, chargeback fees, or payment processing issues arising from your payment method, except where prohibited by law.

If a payment is declined, reversed, disputed, or charged back without valid basis, we may suspend future bookings and pursue recovery of any amounts owed, including reasonable administrative costs and permitted collection expenses.

Promotions, discounts, gift cards, credits, and packages may be subject to additional terms, expiry dates, service restrictions, or non-transferability, as disclosed at the time of purchase.

5. Cancellation and Refund Policy

We value your time and ours. To help us serve all clients efficiently, the following cancellation policy applies unless a different policy is expressly stated in writing for a specific service or promotion:

Refunds are generally not provided for completed services, except where required by applicable law or where we determine, in our sole discretion, that a refund or partial refund is appropriate. Due to the personal and consumable nature of beauty services, dissatisfaction alone does not automatically entitle a client to a refund.

If you have concerns about a service, you must notify us within a reasonable time after the appointment, and in any event as soon as practicable, so we may assess the concern and, where appropriate, offer a correction, adjustment, or other remedy at our discretion and in accordance with applicable law.

Any refund, credit, or service adjustment is subject to verification of the original booking and payment, and may exclude third-party processing fees where permitted by law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Lumière Atelier Beauty Studio, its owners, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our services, including loss of enjoyment, loss of time, or loss of opportunity.

Beauty and personal care services may involve inherent risks, including but not limited to skin irritation, allergic reactions, redness, swelling, discomfort, staining, breakage, or other temporary or permanent effects. You acknowledge that results may vary based on individual skin type, hair type, health conditions, prior treatments, and adherence to aftercare instructions.

We do not guarantee specific outcomes, including but not limited to exact color results, symmetry, longevity, or suitability of any service for your individual needs.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable Canadian law, including liability for gross negligence, wilful misconduct, or any non-excludable consumer rights.

Where liability cannot be fully disclaimed, our total aggregate liability to you for any claim arising out of or relating to the services shall be limited to the amount you paid to us for the specific service giving rise to the claim, to the extent permitted by law.

7. Intellectual Property Rights

All content created, owned, or licensed by Lumière Atelier Beauty Studio, including but not limited to logos, branding, service descriptions, photographs, graphics, text, training materials, website content, and promotional materials, is protected by applicable intellectual property laws.

Any photographs or videos taken by us in connection with services may be used for portfolio, educational, or marketing purposes only where permitted by law and, where required, with your consent.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

Personal information may include your name, contact details, appointment history, service preferences, skin or health-related information you voluntarily provide, payment information, and communications with us.

We use personal information for purposes including:

We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

By using our services, you consent to the collection, use, and disclosure of your personal information as described in our privacy practices and as otherwise permitted or required by law. If we maintain a separate privacy policy, that policy forms part of our privacy framework and should be read together with these Terms.

9. Force Majeure

We shall not be liable for any delay, cancellation, failure to perform, or interruption in services caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, power outages, labour disputes, public health emergencies, government actions, supply shortages, transportation disruptions, equipment failures, or internet/service outages.

In such circumstances, we may reschedule appointments, modify services, or temporarily suspend operations without liability, except as required by applicable law.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our business practices, legal requirements, or operational needs. The updated Terms will be effective when posted on our website, made available in-studio, or otherwise communicated to you, unless a later effective date is stated.

Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them, or to the services provided by Lumière Atelier Beauty Studio, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

You agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or relating to these Terms or our services, subject to any mandatory consumer protection or arbitration rights that cannot be waived under applicable law.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions remain in full force and effect, to the fullest extent permitted by law.

Any failure by us to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision unless expressly acknowledged by us in writing.

By booking or receiving services from Lumière Atelier Beauty Studio, you acknowledge that you have read, understood, and agree to these Terms of Service.
